Inda Terapias S.L., the party responsible for the website, hereinafter the CONTROLLER, makes this document available to users in order to comply with the obligations set forth in Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSICE), as well as to inform all website users of the terms of use.

Any person who accesses this website assumes the role of user and undertakes to strictly observe and comply with the provisions set forth herein, as well as with any other applicable legal provisions.

Inda Terapias S.L. reserves the right to modify any information that may appear on the website without being required to provide prior notice or otherwise inform users of such changes; publication on the Inda Terapias S.L. website shall be deemed sufficient.

2. PURPOSE

Through the Website, we offer Users the opportunity to access information about our services.

3. PRIVACY AND DATA PROCESSING

Where access to certain content or services requires Users to provide personal data, Users shall guarantee that such data is truthful, accurate, authentic and up to date. The company shall process such data by automated means as appropriate to its nature or purpose, under the terms set out in the Privacy Policy section.

The User acknowledges and accepts that all content displayed on the Website, particularly designs, texts, images, logos, icons, buttons, software, trade names, trademarks and any other signs capable of industrial and/or commercial use, is subject to Intellectual Property rights. Accordingly, the User undertakes not to reproduce, copy, distribute, make available, publicly communicate in any other manner, transform or modify such content, and shall hold the company harmless against any claim arising from a breach of these obligations.

Under no circumstances does access to the Website entail any waiver, transfer, licence or total or partial assignment of such rights, unless expressly stated otherwise. These General Terms of Use of the Website do not grant Users any right to use, alter, exploit, reproduce, distribute or publicly communicate the Website and/or its Content other than as expressly provided herein. Any other use or exploitation of any rights shall be subject to the prior and express authorisation specifically granted for that purpose by the company or by the third party that owns the rights concerned.

The content, texts, photographs, designs, logos, images, computer programs, source code and, in general, any intellectual creation existing on this Website, as well as the Website as a whole as a multimedia artistic work, are protected by intellectual property legislation. 5. OBLIGATIONS AND RESPONSIBILITIES OF WEBSITE USERS

The User undertakes to:

  1. Make appropriate and lawful use of the Website and its content and services in accordance with: (i) the legislation applicable at any given time; (ii) these General Terms of Use of the Website; (iii) generally accepted standards of morality and good conduct; and (iv) public order.

  2. Obtain all the means and technical requirements necessary to access the Website.

  3. Provide truthful information when completing the forms on the Website with their personal data and keep such data updated at all times so that it reflects the User's actual situation at any given time. Obtaining or attempting to obtain the content using means or procedures other than those that, as applicable, have been made available for that purpose, have been expressly indicated on the web pages where the content is located, or are generally used on the Internet because they do not pose a risk of damage to or disablement of the Website and/or its content.

  9. In particular, and by way of illustration only and without limitation, the User undertakes not to transmit, disseminate or make available to third parties any information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software or, in general, any kind of material that: • Is in any way contrary to, disparages or infringes the fundamental rights and civil liberties recognised by the Constitution, international treaties and all other applicable legislation. • Induces, incites or promotes criminal, degrading, defamatory or violent conduct or, in general, conduct contrary to the law, morality, generally accepted standards of good conduct or public order. • Induces, incites or promotes discriminatory actions, attitudes or thoughts based on sex, race, religion, beliefs, age or status. • Incorporates, makes available or provides access to criminal, violent, offensive, harmful or degrading products, elements, messages and/or services or, in general, products, elements, messages and/or services that are contrary to the law, morality, generally accepted standards of good conduct or public order; or that cause or may cause an unacceptable state of anxiety or fear. • Induces or encourages participation in practices that are dangerous, risky or harmful to health or psychological well-being. • Is protected by intellectual or industrial property legislation and belongs to the company or to third parties, where the intended use has not been authorised. • Is contrary to the honour, personal and family privacy or personal image of individuals. • Constitutes any form of advertising. • Includes any virus or program that prevents the Website from operating normally.

If the User is provided with a password to access any of the Website's services and/or content, the User undertakes to use it diligently and to keep it secret at all times. Consequently, the User shall be responsible for its proper custody and confidentiality and undertakes not to transfer it to third parties, either temporarily or permanently, or to allow unauthorised persons to access the aforementioned services and/or content. The User likewise undertakes to notify the company of any event that may involve improper use of the password, including, by way of example, theft, loss or unauthorised access, so that it may be cancelled immediately. Continuous access to, or the correct display, downloading or usefulness of, the elements and information contained on the Website is not guaranteed where such access, display, downloading or usefulness may be prevented, hindered or interrupted by factors or circumstances beyond the company's control. The company shall not be liable for decisions made as a result of accessing the content or information provided.

The service may be interrupted, or the relationship with the User may be terminated immediately, if it is detected that the use of the Website or any of the services offered through it is contrary to these General Terms of Use. We shall not be liable for any loss, damage, claims or expenses arising from use of the Website. The company shall only be responsible for removing, as soon as possible, any content that may cause such harm, provided it is notified accordingly. In particular, we shall not be liable for harm arising from, among other things:

  1. Interference, interruptions, failures, omissions, telephone faults, delays, blockages or disconnections in the operation of the electronic system caused by deficiencies, overloads or errors in telecommunications lines and networks, or by any other cause beyond the company's control.

  4. Security or browsing errors caused by a browser malfunction or by the use of outdated browser versions. The Website administrator reserves the right to remove, in whole or in part, any content or information present on the Website.

The company excludes all liability for loss or damage of any kind arising from Users' misuse of the services that are freely available for use on the Website. The company is likewise released from all liability for the content and information that may be received through data collection forms, which are provided solely for the purpose of responding to enquiries and questions. Furthermore, where unlawful or improper use of such services causes loss or damage, the User may be held liable for the loss or damage caused. You shall hold the company harmless against any loss or damage arising from third-party claims, actions or proceedings resulting from your access to or use of the Website. You also undertake to indemnify the company against any loss or damage arising from your use of robots, spiders, crawlers or similar tools for the purpose of collecting or extracting data, or from any other action on your part that imposes an unreasonable burden on the operation of the Website.

The User undertakes not to reproduce the Website or any of its content in any way, including by means of a hyperlink, without the controller's express written authorisation.

The Website may include links to other websites managed by third parties in order to facilitate the User's access to information from partner companies and/or sponsors. Accordingly, the company is not responsible for the content of such websites and does not act as guarantor or as a party offering any services and/or information that may be made available to third parties through third-party links.

The User is granted a limited, revocable and non-exclusive right to create links to the Website's home page solely for private, non-commercial use. 8. DATA PROTECTION

To use some of the Services, the User must first provide certain personal data. The company shall process such data by automated means and implement the corresponding security measures, all in compliance with the GDPR, the LOPDGDD and the LSSI. The User may consult the policy governing the processing of personal data, as well as the purposes previously established for that processing, under the terms set out in the Privacy Policy.

The company reserves the right to use cookie technology on the Website in order to recognise the User as a frequent User and personalise their use of the Website by preselecting their language or the content they most desire or that is most relevant to them.

11. FORCE MAJEURE

The company shall not be liable in any circumstances where it is unable to provide the service due to prolonged interruptions in the electricity supply or telecommunications lines, industrial disputes, strikes, rebellion, explosions, floods, acts or omissions of the Government or, in general, any event of force majeure or unforeseeable circumstances beyond its control.

12. DISPUTE RESOLUTION, GOVERNING LAW AND JURISDICTION

These General Terms of Use, as well as the use of the Website, shall be governed by Spanish law. For the resolution of any dispute, the parties shall submit to the Courts and Tribunals of the registered office of the Website Controller.

If any provision of these General Terms of Use is found to be unenforceable or void under applicable law or as a result of a judicial or administrative decision, such unenforceability or invalidity shall not render these General Terms of Use as a whole unenforceable or void. In such cases, the company shall amend or replace the provision with another provision that is valid and enforceable and that, to the greatest extent possible, achieves the objective and intent reflected in the original provision.
